A. Initial Position
Austrosoft Weiss Datenverarbeitungs GmbH and fms GmbH (hereinafter referred to as “fms/Austrosoft” or “we” or “us”) take the protection of your personal data, the collection, usage and the disclosure thereof, very seriously. This Privacy Statement describes the data protection practices of fms/Austrosoft regarding information provided by you through the websites operated by us (www.austrosoft.at and www.fms.at). We shall process your data exclusively in compliance with the applicable legal specifications (GDPR, Austrian TKG 2003).
This Privacy Statement neither applies to the practices of third parties that are not owned or controlled by fms/Austrosoft nor to persons who are not employed by fms/Austrosoft or who do not accept instructions by fms/Austrosoft.
B. Which type of information is collected by fms/Austrosoft?
Personal data. “Personal data“ are types of information that can identify you or a third person directly or indirectly. These data may comprise the following: name, title, company name, job title, postal address, phone number, email address, browser and device information (including the IP-address) and information collected by cookies and similar technologies. As soon as you transmit personal data of third persons to us or to our service providers in connection with the websites, you declare that you have been authorised to do so and that you allow us to use the information in accordance with this Privacy Statement.
Other information. “Other information“ is information that cannot be used to reveal your identity or the identity of a third person, e.g. information that has been completely and permanently anonymised and aggregated. We use such information to enable and improve the operations of our websites as well as for the other purposes described below.
C. How does fms/Austrosoft collect information?
We and our service providers collect personal data and other information in a number of ways, including:
>Via the websites: We collection information via the websites, e.g. when you download contents (e.g. product folders), subscribe to our email newsletter or when you contact us.
Offline: We collect information offline, e. g. when you participate in one of our events, make phone calls with our field staff or when contacting a representative of fms/Austrosoft.
Obtained from you: fms/Austrosoft collects information such as your location of your preferred means of communication if you have provided us with this information on a voluntary basis. As soon as this information is not combined with personal data, this information will neither identify you nor other users of the websites personally.
Information from other sources: We retrieve information about you from other sources such as public databases or other third parties to increase our ability to offer you relevant marketing, special offers and services.
Via your browser or your device: Via your device, specific information is collected by most of the browsers automatically, e.g. the MAC address, the computer type (Windows or Macintosh), the screen resolution, name and version of the operating system, the manufacturer and the model of the device, the language, the type and the version of the internet browser as well as the name and the version of the websites used by you (e. g. apps). Your “IP-address” is a number that is automatically assigned to your computer by your internet service provider (ISP). When you access the websites, the IP-address – together with the time of your visit and the site(s) visited by you – can be automatically identified and protocolled in our server protocol files. Collecting IP-addresses is a standard procedure carried out automatically by many websites, applications and other services. fms/Austrosoft uses IP-addresses to calculate the level of use of the website, to administer the website and to monitor the regions from which you navigate to the websites of fms/Austrosoft.
Via cookies and other similar technologies: “Cookies” are small files that contain frequently used information stored on a person’s device to facilitate this person’s communication and interaction with the websites. When you visit our websites, we may send one or more cookies to your device. These cookies enable us to store data about your device that will, among other things, help us to provide you with a good user experience on our websites and to improve the level of the offered services and functionalities.
D. How does fms/Austrosoft use personal data?
We use personal data:
to provide our services according to our Terms and Conditions, to communicate with customers and suppliers, to orderly carry out orders and deliveries of our products as well as to process payments which have been notified to us within the scope of the business relation.
to answer your enquiries and to fulfil your requests such as the sending of required material and newsletters as well as information and materials regarding our products and services.
to send you administrative information such as information on the websites and on changes of our conditions and guidelines.
to provide you with marketing news we think that could be of interest for you, by post or by email in accordance with the applicable legislation and your preferences.
to perform our business purposes such as the increase of our performance or the modification of our websites and services, the identification of usage trends and the assessment of the effectiveness as well as to carry out advertising campaigns.
Our legal basis for the collection and the usage of the personal data described above depends on the personal data in question and on the specific context in which we collect them. We shall collect and use your personal data if the processing thereof is in our legitimate business interests, such as for direct marketing and the sale of our products to potential business customers (B2B). In some cases we may even be legally obliged to collect your personal data.
State-of-the-art security standards are applied to ensure your private security. We take the protection of these data, of our customers’ privacy rights as well as confidentiality very seriously.
E. How can I access, change or delete information about me?
If you want to access, correct, change or delete personal data or if you want to to limit the usage and/or disclosure of such data that have been collected and stored by fms/Austrosoft, or if you want these data to be transmitted to a third organisation, please let us know under . We will check and answer your request in compliance with applicable laws. If you want to object to the usage of your personal data for direct marketing purposes, please use the mechanisms described in section G (“Which options do I have?”). For your protection, we only implement those requirements relating to personal data that are linked with the email address of your request and additionally, we have to check your identity before implementing your request. We shall answer your request within 30 days. Please note that we are obliged to store specific data for storage purposes and/or for the completion of transactions started by you prior to the request of such access, change or deletion.
F. How long will fms/Austrosoft store my personal data?
We shall store your personal data for the period of time that abides by the original purpose of the collection of the data, including the pursuit of our legitimate business interests, the compliance with our legal obligations, the settlement of disputes and the implementation of applicable agreements.
G. Which options do I have?
You can decide not to disclose information at any time, however, if you decide to do so, we probably will not be able to fully answer to your request or may provide you with limited services only. You can object receiving marketing news by fms/Austrosoft by following the subscribe or unsubscribe link in an email; by unsubscribing using the de-registration form under www.fms.at/abmeldung or by sending an email to . We shall process your request as soon as possible. If you decide against receiving marketing-related emails, you may still receive important administration-related news by us.
H. Websites by third-party providers
Using these websites, you can visit other internet websites via direct links, or other websites may also contain links to our websites. The practice of providing information or the contents of other websites is subject to the privacy statements of such websites and is not subject to this Privacy Statement. We recommend that you read the data protection guidelines of these third-party websites, services and applications to understand how your data are collected and used by them. Please also note that we are not responsible for the guidelines and practices relating to the collection, usage and disclosure (including data protection practices) of other organisations such as Facebook, Google, LinkedIn, Microsoft or providers of social media platforms, operating system providers, mobile providers of device manufacturers, including all personal data communicated by you to other organisations via or in connection with the apps or the social media pages.

fms/Austrosoft may possibly change this Privacy Statement in due time. The indication “Entry into force” on the top of this page specifies when this Privacy Statement has been revised last. Changes of this Privacy Statement will come into force after the publication of the revised Privacy Statement on the websites.
